Copyright in Art - negotiating the blurred lines

Copyright is tricky, and it is about to get even more difficult.

    Unfortunately, copyright is only one part of the story. In Austria, Germany and a few other places there is law called Das Recht am eigenen Bild. (The right to a picture of you.) Basically it says, you aren't allowed to take / use / distribute picture about people (as long as they are recognizable), unless they explicitly allow it.

    This puts street photographers in a very tricky situation and the only reason they are probably able to get away with it is that most people don't know about this and / or are not willing to sue.

    There are a few exceptions to this, for example politicians or group shots, but it's a gamble every time we go out and shoot.

    I think this is something that should be mentioned more.

    I do not mind one photographer trying to recreate a photo, if they give credit for the original concept. Useful in learning, as student painters try to reproduce masterpieces in many art schools. Credit the principle idea there. Now, trying to give credit to everything is silly. Keep these reproductions to studies, portfolios, and such, and there is not a problem. Place on display for sale? Problem without credit.
